Purpose and Principles

CHAPTER-1

The Principles of the I.H.R.C. are:

(1) To save succeeding generations from the scourge of way which has in our life time has brought untold sorrow to mankind and
(2) To reaffirm faith in fundamental human rights in the dignity and worth of human person in the living rights of men and woman and of nations large and small and
(3) To establish conditions under which justice and respect for obligation arising from treaties and other sources of national/International Laws can be maintained and
(4) To promote social progress and better standard of life in larger Freedom.
(5) To practice tolerance and live together in peace with one another as good neighbors and
(6) To unite our strength to maintain national/ international peace and security and
(7) To insure by the acceptance of principals and Institution of methods that armed force shall not be save in the common Interest and
(8) To employ national / International machinery for the promotion of the economics and social advancement of all people.
(9) To maintain national / international peace and security and that end. To take effective collective measures for the prevention and removal of threats to the peace and for the suppression of acts of aggression or other beasties of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and settlement of human disputes or situation which might lead to a breach of the peace,
(10) To develop friendly relations among nation, based on respect for the principle of equal right and self determination of people and to take other appropriate measures to strengthen universal peace,
(11) To achieve International Corporation in solving National problem of, Social culture, or humanitarian character, and in promoting and encouraging respect for all with out destination as race, sex, language or religion.
(12) To be a centre for harmonizing the action of nations in the attainment of these common ends

CHAPTER-II

COUNCIL MEMBERSHIP OF I.H.R.C.
The organization and its state council member in pursuit of the purpose started in chapter I, Shall act in accordance with the followings principles:-

1. The organization is based on the principle of sovereign quality of all its state council members.
2. All state council members, in order to ensure to all of them the right and benefits resulting from membership shall fulfill in good faith the obligations assumed by them in accordance with the presents character
3. All state council member shall settle their state / District Disputes by peaceful means in such a manner that National / International place and security and justice, are not endangered.
4. All state council members shall retrain in their national / relations from the threat or use of force against the territorial integrity or political independence of any district or any other manner inconsistent with the purpose of the Indian nations.
5. All state council member shall give the Indian Nations every assistance in any action it takes in accordance with the present charter, and shall refrain from giving assistance to any District against which the head office is taking preventive or enforcement action.

The organization on has been appointing the state council member, which posts are follows:

Article1.


The validity of state council member is life time.
Atricle 2.


(a) The Admission of any such Person to membership in I.H.R.C. State council membership will be elected by a decision of the state council president upon the recommendation of state president
(b) After receiving the recommendation of state council president the organization will be to sent state council member, I-card / Authorization letter and other documents to his given address as soon as earlier.
Atricle 3.


Each state council member shall not appoint more that 7th District committee and with consent of the state president.

The organization has been appointing the District Council Committee Members which post as follows:-
1. Convener
2. Joint Convener
3. Treasurer
4. Active Member – Four Members

CHAPTER - IV

FUNCTIONS AND POWERS OF STATE CONCIL MEMBER OF I.H.R.C.

Atricle 1.


The State Council Members may discuss any question or any matters regarding any district member /person / any cases related to human rights violations etc. The members may also call or mail 24 Hours to the National head quarters of IHRC.
Atricle 2.


The organization will bear all expenses towards boarding & lodging whenever they are invited in any national /international program..
Atricle 3.


The organization will provide concessional railway passes to the state council Members under V.I.P quota.
Atricle 4.


The organization will open a savings bank account in any MNC Bank branch nearest to the office/residence of the members in every state. The Bank account will be jointly operated by state council President and National Representative both.
Atricle 5.


The state council member shall be always organized and aware about various activities/programs in order to devote their full time for the smooth functioning of the IHRC. Each member of state council shall make him self available for the purpose of coordination in the awareness programs at state H.Q and District H.Q.
Atricle 6.


The state council shall adopt its own rule of procedure, including the method of selecting the state council president regarding. They will always work under the rules and regulations as prescribed by IHRC at all times.
Atricle 7.


All the members would Endeavour to find/offer a solution to the people about any dispute without any boundations on cast, religion or any other factor. The sole purpose of any negotiation/offer for solution by IHRC members would be to keep the national peace and security above all. They would, first of all, seek a solution by negotiation, enquiry, mediation, conciliation, arbitration judicial statement, resort to region agencies or arrangement, or any other peaceful means as per the prevailing circumstances.
Atricle 8.


The state council shall, when it deems necessary, call upon the parties to settle their dispute by such means.
Atricle 9.


The state council member can get time to time report of Organization Development by letter or by E-mail and also get monthly magazine at their residence/office address.
Atricle 10.


The state council members are welcome to send any type of news/article related to Human rights activities in their state for publishing the same in forthcoming edition of IHRC magazine. They are requested to kindly send the articles along with the supporting pictures/documents etc. in order to facilitate speedy selection of their articles.
Atricle 11.


The organization will provide all the stationary including Visiting cards, letter pads, Envelopes, Pens, Rough Papers, Posters, Stickers etc. to all state council members and district members once a year. "Let us resolve to combine our offers in order to accomplish the AIMS"

CHAPTER – V

IHRC CELL
The IHRC has different cell which is follows:

1. Women Cell
2. Industrial and Traders Cell
3. Farmer Cell
4. Media and Cultural Cell
5. Labour and Welfare Cell
6. Information and Environmental Cell

The admission of any such women to membership in IHRC Women Cell in State Council Membership will be elected by a decision of the State Council Chairman (Women Cell) upon the recommendation of State Council President.

CHAPTER – VI

I.H.R.C. {MEMBERSHIP} DOCUMENT REQUIRED FOR STATE COUNCIL MEMBER / DISTRICT COUNCIL MEMBER

The person who is interested to get membership of state council / District Council may submit the self attested as followings.
(A). Address proof like Voter card/ Driving license / Rashan card and any Other Related Document for Address proof
(B). For Identify proof {PAN Card If have}
(C). Educational Data {Bio-data}
(D). Membership charges For State Council up to life time {Including Free zonal, magazine of life time, postal expense of Notification letter, Identity card and other documents etc, is Rs-10,000/{Ten Thousand only} in by DD/ crossed check in favor of INTERNATIONAL HUMAN RIGHT COUNCIL payable at Delhi.
(E). District council membership charges up to 10 Year {Including Free zonal magazine postal expenses of Notification letter, Identity card and other documents etc is Rs-5,100 {five thousand one hundred only} in By DD/ check in favor of INTERNATIONAL HUMAN RIGHT COUNCIL payable at Delhi.

Universal Declaration of HUMAN RIGHTS
Atricle1


All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.
Atricle2


Everyone is entitled to all the rights and freedoms set forth in this Declaration. without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.
Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Everyone has the right to life, liberty and security of person.
Atricle4


No one shall be held in slavery or servitude;
slavery and the slave trade shall be prohibited in all their forms.
Atricle5


No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.
Atricle6


Everyone has the right to recognition everywhere as a person before the law.
Atricle7


All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.

Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.
Atricle9


No one shall be subjected to arbitrary arrest, detention or exile.
Atricle10


Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.
Atricle11


(1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.
(2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor and reputation.
Everyone has the right to the protection of the law against such interference or attacks.
Atricle13


(1) Everyone has the right to freedom of movement and residence within the borders of each State.
(2) Everyone has the right to leave any country, including his own, and to return to his country.
Atricle14


(1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.
(2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations.
Atricle15


(1) Everyone has the right to a nationality.
(2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.
Atricle16


(1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.
(2) Marriage shall be entered into only with the free and full consent of the intending spouses.
(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.
Atricle18


Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.
Atricle19


Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.
Atricle20


(1) Everyone has the right to freedom of peaceful assembly and association.
(2) No one may be compelled to belong to an association.
Atricle21


(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.
(2) Everyone has the right to equal access to public service in his country.
(3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures.

Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international cooperation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.
Atricle23


(1) Everyone has the right to work, to free choice of employment, to just and favorable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
(3) Everyone who works has the right to just and favorable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.
(4) Everyone has the right to form and to join trade unions for the protection of his interests. Atricle24


Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.
Atricle25


(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, and housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.
(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.
Atricle26


(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.
(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace.
(3) Parents have a prior right to choose the kind of education that shall be given to their children.

(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.
(2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.
Atricle28


Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.
Atricle29


(1) Everyone has duties to the community in which alone the free and full development of his personality is possible.
(2) In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the Rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.
(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations.
Atricle30


Nothing in this Declaration may be interpreted as implying for any State, group or person any t to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein.

Rights OF IHRC Regarding Investigation of Cases


IHRC will enquire and send report to Human Rights Commission in the following categories of cases:
a) To correspond with/inform witnesses and meet them regularly to ensure their presence during trials, to cross-examine them and help them in other ways;
b) To investigate and solve loss of any document(s) in relation with Human rights Violations etc.;
c) To obtain permission from Commission for cross-examination of papers received from witnesses pertaining to cases in violation of Human Rights;
d) To demand copy(s) of the documents/records from the Govt./Non-Govt. Organizations;
e) To receive signature on witness papers (Affidavits);

Nature of Complaints undertaken by IHRC


1) Complaints against Police Department

(a) On failure to take immediate action after complaint (s),
(b) On rejecting any complaint/application without assigning any reason thereof,
(c) On complaints of false and fabricated cases registered against innocents/complainants;
(d) Using Violence/torture during custody,
(e) Arresting any person illegally,
(f) Any Other excesses/tortures by Police,
(g) Causing death in custody,
(h) Causing death during encounters,

1) Exploitation of Under trials,
2) Excesses on SC/ST/OBCs and others,
3) Bonded Labour/Child Labour issues,
4) Issues related with Child Marriages,
5) Communal riots etc.,
6) Cases of Dowry, dowry deaths or causing death due to dowry demands, demanding dowry,
7) Abduction/Kidnapping, rape & murder etc.,
8) Sexual harassment cases and any type of complaints related with Women And any other types of complaints can be registered with IHRC.

How to register Complaints with IHRC?


i) The complaints can be registered in Hindi, English, Urdu or any other Indian language(s).
ii) One can expect speedy follow up by IHRC after the complaint is duly registered.
iii) There are absolutely no charges to be paid for registration of complaints.
iv) One can send complaints through ordinary post/registered letters, wire/telegram, e-mail, Fax or simply by calling IHRC on telephone.
